The MacNale Case

For two years, 46 year old Mr. MacNale suffered from right ear pain, a blocked ear canal and a seeping cyst in his ear. Eventually, he lost his hearing on the right and his face drooped.

Mr. MacNale went to his Family Practice Clinic five times, the Emergency Room three times and Ear Nose and a Throat Specialist four times. Each time he was seen, the physicians treated his symptoms but never thought to find out why he had these long term problems and why the treatment did not work.

He was finally sent to a new Ear Nose and Throat Specialist and was immediately diagnosed with Stage 4 cancer in his right ear canal and right side of his face.

Because of the delay in diagnosis by the physicians at the Family Practice Clinic and by Ear Nose and Throat Specialist, Mr. MacNale’s cancer spread and became very advanced. In spite of treatment his cancer has returned.

Plaintiff sought damages for PAST and FUTURE pain and suffering, loss of enjoyment of life and physical deformity due to the delayed diagnosis and treatment of cancer.

Plaintiff settled out of Court for a substantial amount.
